ODIHR Legal Reviews, Assessments
Variety of useful resources and tools prepared by ODIHR to support legal reform in OSCE participating States. It includes legal reviews of draft and exisiting national legislation and assessments of legislative process.
Opinions
The Joint Opinion concludes that the law has introduced highly problematic provisions that unduly impact the right to freedom of association and risk having a chilling effect on political pluralism in the country, particularly (i) the increase of the minimum number of members of the party from 1,000 to 5,000; (ii) the need for the already registered political parties to undergo re-registration; (iii) the lengthy terms and cumbersome procedure foreseen for the establishment and registration of political parties; (iv) the prohibition to operate a political party without state registration; (v) the overregulation of internal party structures and operations; (vi) the excessive control exercised by the Ministry of Justice over party activities and over the registers of members of political parties; and (vii) the possibility to suspend the activities of a political party or even dissolve a party in cases not involving serious violations of the legal acts by such a party.
